New Companies

Please follow the steps below to determine if your company is obligated under the Waste Diversion Act (2002) and to discharge any potential obligations it may have under this law.

Are You a Steward?
The Waste Diversion Act requires companies that are designated as "Stewards" of residential "Blue Box Waste" to share in funding 50% of the net cost of Ontario municipal Blue Box programs. The questions below will help you determine if your company is likely to be a steward.

1. Is your company resident in Ontario?

Your company is considered resident in Ontario if you meet at least one condition in (a) and one condition in (b)
a) the company has a permanent establishment in Ontario including a:
  • branch
  • factory
  • warehouse
  • office
  • agency and/or other fixed place of business

AND/

b) the company has employees or agents

  • with authority to contract on its behalf or
  • a stock of inventory with which they regularly fill orders.

Companies not resident in Ontario are not obligated under the WDA but may choose to volunteer to become a steward. Please read the Voluntary Steward Agreement carefully before submitting an application to become a Voluntary Steward. Stewardship Ontario reserves the right to reject Voluntary Steward Agreements.

2. Are you/is your company a "Brand Owner," "First Importer," or "Franchisor" (which is a brand owner) of one or more products sold in Ontario with packaging, or that issues, sells and/or distributes printed material that is managed in the Ontario residential waste stream.

“Brand Owner” and/or “Franchisor” is a company/organization or person that is a registered trademark holder or licensee of a trademark (brand); or a company or person that owns or is the licensee of intellectual property rights of a brand of printed material or product. (If you or your company’s brand or trade mark is on any product or product packaging and/or printed matter, then you or your company is the brand owner of that product and packaging or printed matter).

“First importer” is a company or person that imports products into the province where the brand owner(s) is/are not resident in Ontario. This might be products that are imported from other Canadian provinces or from other countries.

3. Do your products generate Designated Blue Box Waste?

Designated Blue Box Waste (DBBW) is defined as “Packaging and/or Printed Material consisting of one of or a combination of glass, metal, paper, plastic, or textiles” and that is potentially managed in the Ontario Residential waste system.

4. Were your company’s gross Ontario sales for any obligation year beginning with 2002 and continuing to the current year, greater than $2 million? Or is your company a non-profit entity?

Gross Ontario sales is the combined gross revenues from the sale of all products and services in Ontario of your company and all its affiliates (include all commercial and retail sales streams).

Non-profit entities include municipalities, provincial agencies, colleges, and universities

If you answered yes to each question, your company is obligated to file a Steward’s Report with Stewardship Ontario. Please continue to the next step.

If you answered NO to any question, you are not obligated to file a Steward's Report under the BBPP, however we recommend that you register your company and receive an exemption from the program by email.

Choose a Primary Contact
Now that you have determined you are obligated under the WDA, you will need to designate an individual that will be responsible for fulfilling your obligations.

A “primary contact” is the individual who will co-ordinate this process for your company, who Stewardship Ontario will contact as necessary and to whom we will provide program information updates. The role and purpose of the primary contact is to:

  • act on behalf of your organization with respect to your legal obligation;
  • authorize payments;
  • gather information internally and file your Steward’s Report.

Register your Company with Stewardship Ontario
Obligated Brand Owners, First Importers and Franchisors doing business in Ontario are required to register with Stewardship Ontario. You will need:

  • company information (address, main telephone number, etc);
  • primary contact information (title, email, address telephone number, etc);
  • gross Ontario Sales figures for 2002, 2003, 2004, 2006, 2007, 2008 and 2009 (see definition as outlined above in question 4 under Are you a Steward?);
  • information about whether your company had DBBW in 2002, 2003, 2004, 2006, 2007, 2008 and 2009 (as per definition outlined above in question 3: Are you a Steward?).

Obligated stewards or companies wanting to register may click here. Once registered obligated stewards will receive an email containing a key information they need to log on to the Steward Reporting system.

Companies that declare that they are not obligated to file a Steward’s Report will receive an email to this effect.

  • Stewardship Ontario may contact you to verify these declarations.
  • If your company has already registered you will not be able to register a second time. Please contact Stewardship Ontario’s Customer Service Group at (888) 288-3360 for further information.
  • Stewardship Ontario will only send log on information to the primary contact's email address provided.

Collect your Data for your Steward's Report
Obligated Companies are required to file a Steward’s Report for every year for which they are obligated. Before you start, you will need to understand four key concepts.

  • Gross Ontario Sales (GOS): the combined gross revenues from the sale of products and services in Ontario of your company and all its affiliates. To be obligated, these must be greater than $ 2 million for a specified data year. Organizations are to include the sales of all products and services from all divisions and affiliates in Ontario.
  • Designated Blue Box Waste (DBBW): includes any one of or a combination of glass, metal, paper, plastic, or textiles and that were potentially disposed of in the Ontario Residential waste system. If your company sold/distributed products with Packaging and/or Printed Material consisting of DBBW for a specified data year, the company is obligated.
  • Data Year: is the calendar year (2002, 2003, 2004, 2006, 2007, 2008 or 2009) for which stewards collect Packaging and Printed Material data for use in calculating their obligation under the WDA.
  • Obligation Year: is the calendar year in which stewards are obligated to produce Steward’s Reports and potentially pay fees to Stewardship Ontario. Obligation years to date include:
    • 2003 & 2004 obligation years
      Companies with gross Ontario Sales greater than $2 million and with DBBW in 2002 collect and file Steward’s Reports with 2002 data for these obligation years. (Please note, the 2002 data only needs to be filed once; when the 2003 Steward's Report is submitted the 2004 Steward's Report will automatically be generated.)
    • 2005 obligation year
      Companies with gross Ontario Sales greater than $2 million and with DBBW in 2003 collect and file Steward's Reports with 2003 data for this obligation year.
    • 2006 obligation year
      Companies with gross Ontario Sales greater than $2 million and with DBBW in 2004 collect and file Steward's Reports with 2004 data for this obligation year.
    • 2007 obligation year
      Companies with gross Ontario Sales greater than $2 million and with DBBW in 2006 collect and file Steward's Reports with 2006 data for this obligation year.
    • 2008 obligation year
      Companies with gross Ontario Sales greater than $2 million and with DBBW in 2007 collect and file Steward's Reports with 2007 data for this obligation year.
    • 2009 obligation year
      Companies with gross Ontario Sales greater than $2 million and with DBBW in 2008 collect and file Steward's Reports with 2008 data for this obligation year.
    • 2010 obligation year
      Companies with gross Ontario Sales greater than $2 million and with DBBW in 2009 collect and file Steward's Reports with 2009 data for this obligation year.

Please note due to a program modification for 2007, stewards will never be required to collect and submit 2005 data to Stewardship Ontario.

Stewards are required to collect and report the annual weight of their obligated packaging and printed material in kilograms by material.

Note: stewards with outstanding Steward’s Reports are required to file them in chronological order starting from 2003 to 2010.

Reporting Calculators
Stewardship Ontario has authorized the use of several reporting calculators for specific sectors, for a defined lists of products. If you are unable to obtain actual packaging data for your company’s DBBW, there may be an approved reporting calculator available that you may use estimate the weight of materials for which your company is obligated. Note: calculators may only be used as approved by Stewardship Ontario. To be approved for a calculator, please see Apply to Use a Calculator.

File/Submit your Steward’s Report
Entering
Once you have collected all your Packaging and Printed Material weight data, you will enter the information on Stewardship Ontario’s Steward Reporting System. You will need your log on information to access the system. If you do not have this please contact Customer Service at (888) 288-3360 and we will email it to the primary contact on file.

Stewards are now required to include all brand names, and affiliated companies, included in their steward's report.

Fee Calculations
The reporting system automatically calculates how much each obligated steward is required to pay, based on the amount of each DBWW material that they used in Packaging or Printed Materials during the "data" year.

You can view tables of the fee rates that are applied to the various material categories. These tables are also shown in the "Rules" posted for each obligation year.

Reporting and Payment Timelines
Reporting and Payment deadlines for the all obligation years are 93 days from each steward’s date of notification for each obligation year.  Please view the Rules to determine when Payment of fees was required for previous obligation year.

Penalties and Interest
Companies obligated under the Waste Diversion Act, 2002 that fail to pay fees as set out in the Reporting and Payment Schedule will be subject to penalties and interest charges. For more information, please see the penalties and interests section shown in the Rules of each obligation year.
