Minister of Environment Approves Consolidated
Municipal Hazardous or Special Waste Plan for Program
Launch on July 1, 2010
On September 22, Ontario’s Minister
of the Environment, the Hon. John Gerretsen approved
the Consolidated Municipal Hazardous or Special Waste
Plan (CMHSW). In a letter to Waste Diversion Ontario,
Minister Gerretsen requested that the program commence
on July 1, 2010. To view the Minister’s letter:

Who are Obligated Stewards of
the CMHSW Program
All stewards of
the Phase 1 MHSW program which launched on July 1, 2008
will continue as stewards for the CMHSW program. Additional
stewards include any company that is a brand owner or
a first importer of any of the designated materials
supplied for sale or use in the Ontario market.
The designated materials that are for
sale or use in the Ontario marketplace are:
- Into the residential and all
industrial-commercial-institutional (IC&I) sectors*:
- all batteries (excluding lead
acid batteries from vehicles)
- Into the residential sector only:
- pharmaceuticals (including prescription
drugs, natural health products and over-the-counter
medications)
- sharps including syringes
- Into the residential and IC&I
small quantity generator sectors
- aerosol containers
- portable fire extinguishers
- fluorescent light bulbs
and tubes (limited to generators of no more than
5kg/month)
- switches that contain mercury
- mercury containing measuring
devices (e.g., thermostats, thermometers, barometers
and other measuring devices)
- paints and coatings and their
containers
- solvents and their containers
- lubricating oil containers
with a capacity of 30 litres or less
- used oil filters
- antifreeze and its containers
- pressurized containers
- fertilizers, fungicides,
herbicides, insecticides and pesticides and their
containers
- flammable materials (e.g.,
fuel, kerosene, cleaners, strippers, propane, etc.)
- corrosive materials (e.g.,
muriatic, sulphuric acids; cleaning products, drain
openers, paint remover, etc.)
- toxic materials (e.g., adhesives
such as contact cement, glues, epoxies, wood preservatives,
etc.)
- reactive materials (e.g.,
materials that explode such as Isocyanate foams
and metal powders)
- leachate toxics (e.g., materials
that upon extraction produce an extract containing
a toxic substance).

Please note that a number of materials
designated under the MHSW Program may no longer be supplied
for sale or use in Ontario (e.g., mercury switches and
mercury-containing measuring devices). These are referred
to as ‘obsolete’ waste. Stewards of obsolete
materials are still obligated to register with Stewardship
Ontario, even though they have ceased to supply this
material for sale or use in Ontario. See Appendix C
of the Rules at page 146 of the Consolidated
MHSW Program Plan, Vol. 1 for more details.
Also please note that if a company supplies
for sale or use in Ontario a product that contains any
of the designated materials, will be an obligated steward
under this program.
Steward Fees
The Consolidated
MHSW Program Plan contains a preliminary schedule of
material fees. These fees will be amended based 2009
sales data to be provided by stewards by March 31, 2010.
The recalibrated fees will be provided to stewards in
all material categories before the program begins on
July 1, 2010. To view the preliminary schedule of material

Key Dates
for Stewards
March
31, 2010-stewards of Consolidated MHSW materials
will be required to file reports on 2009 sales as a
basis for Stewardship Ontario to amend steward fees
for 2010.
July 1, 2010-is the
official start date of the new Consolidated MHSW program.
This is the date on which Stewardship Ontario collection
and recycling services will include the additional materials
that are encompassed by the consolidated program.
July 31, 2010-by
the end of July 2010, all stewards of designated products
(listed above) will be required to file their first
steward report based on the period April 1–June
30, 2010. Steward reports and fees will be due quarterly
after that. The actual payment calculation will be based
on one-quarter of the 2009 Annual MHSM Stewards’
Report (required to be filed at the end of March 2010).
At the end of 2010, Stewardship Ontario will reconcile
both years.
Program Updates
Stewardship Ontario has added
a new page to its website that will keep all stewards
and potential stewards apprised of developments concerning
this new program. Please add this page to your ‘favourites’
and be sure to check back intermittently to get updates
on what is required to fulfill your obligation under
the Waste Diversion Act, 2002. Next month Stewardship
Ontario will open a registration page so that companies
can provide the name and coordinates of the person in
the company who should be the primary contact for communication.
